I'm pretty sure it is a tern, maybe a juvenile, having it's dinner.  This picture was taken in December at Sanibel Island, Florida.

This bird is a laughing gull, non-breeding adult. They are common in Florida and here in New York, too.
Nice shot with bird engaging with its environment, i.e. eating.
